SWEEPSTAKES TO WIN A TRIP TO SEE

HARRY POTTER AND THE CURSED CHILD IN LONDON, ENGLAND

(the “Sweepstakes”)

By entering the Sweepstakes, each Entrant (as defined below) (and where applicable the Entrant’s parent or legal guardian) unconditionally accepts and agrees to comply with these terms and conditions (“Rules”) and agrees to be bound by the decisions of the Promoter in respect of the interpretation of these Rules and otherwise in relation to the Sweepstakes. Entrants who do not comply with the Rules will not be eligible to win the prize.

1. Eligibility Requirements

  • The Sweepstakes and grand prize are open to all legal residents (or minor dependent thereof) of, and physically residing in one (1) of the fifty (50) United States or the District of Columbia.
  • The Sweepstakes begins at 5:00:00 pm EST on 20th March 2019 and ends at 11:59:00 pm EST on 3 April 2019 (the “Sweepstakes Period”).
  • Only one entry per person.

2. Parental Consent

To be eligible to participate in this Sweepstakes, all entrants under the age of 18 (“Minor Entrants”), must:

  • Obtain consent from a parent or guardian (“Parental Consent”)
  • Cause such parent or guardian to complete and submit the entry form located at harrypottertheplay.com/us/sweepstakes (including, without limitation, such parent or guardian’s e-mail address) (together with any other Entry materials) on behalf of the Minor Entrant.

By submitting the Requested Information on behalf of Entrant, Entrant’s parent or guardian consents to Minor Entrant entering the Sweepstakes, receiving e-mail communication from Promoter, and such Entrant’s parent or guardian may be asked by the Promoter to verify he/she is the parent or legal guardian and able to provide Entry on behalf of entrant.  The Requested Information will only be used internally by the Promoter to evaluate the Entry and will not be shared with third parties.  The Promoter will not request or require an Entrant under the age of 18 to provide more information than is necessary for the Entrant to participate in this Sweepstakes. 

Further, as the parent or guardian you may:

  • Review the entry materials of your minor
  • Direct Promoter to delete the Entry and requested information, and (c) refuse to allow any further collection of Information.

3. How to Enter

  • No purchase is necessary to take part in this Sweepstakes
  • Entrants may enter the sweepstakes by completing the below tasks:
    • Post a photo or video to one of their social media accounts (Facebook, Twitter, Instagram or YouTube) sharing their love forHarry Potter and the Cursed Child using #MyCursedChildNYC
    • Visit harrypottertheplay.com/us/sweepstakes and complete their entry by inputting their email address, inputting the link to their social post noted above, inputting their zip code and by checking that they have read the official terms and conditions.
  • After the conclusion of the Sweepstakes Period, the winner of the Sweepstakes (“Sweepstakes Winner”) will be selected at random from all valid Entries by or on behalf of the Promoter. The Sweepstakes Winner will be notified by email.
  • Promoter’s decision determining the Sweepstakes Winner and all matters relating to the Competition will be final and binding.

4. Prize

One (1) grand prize will be awarded to the Sweepstakes Winner. Prize includes a three (3) day / two (2) night trip to London, England for Winner and one (1) guest (individually, “Sweepstakes Winner,” the Guest and Winner shall collectively be referred to as the “Group”) to attend a performance of Harry Potter and the Cursed Child in London, England at The Palace Theatre on a date selected by the Promoter between September 1, 2019 – November 15, 2019. 

If the winner is under the age of eighteen (18), Winner must select as his/her Guest a parent or legal guardian. 

The Trip consists of the following elements for the Group:

  • Two (2) round trip coach airfares between the major gateway airport closest to Winner’s residence (“Airport of Origin”) and an airport in London, England chosen by the Promoter
  • Hotel accommodations (one (1) room/double occupancy) for two (2) nights at a hotel selected by Promoter in its sole discretion
  • Two (2) tickets to see Part One and Part Two ofHarry Potter and the Cursed Child (performance date and time and location of seats subject to Promoter’s discretion).

Approximate Retail Value (“ARV”) of Prize: $3300, which will vary depending on point of departure and seasonal fluctuation of hotel rates and airfares. The prizes do not include:

  • Any on ground travel
  • Any additional tickets, airfare or hotel accommodations
  • Anything not detailed above;
  • Any insurance arrangements;
  • Any taxes which may be payable as a consequence of receiving the prize (other than those detailed above); or
  • Any spending money, souvenirs, drinks, meals, gratuities and incidentals

5. Notifying the Sweepstakes Winner

The Sweepstakes Winner will be informed by email by the Promoter (as defined below) by April 10, 2019. The Sweepstakes Winner will be required to confirm acceptance of their prize in an email within forty-eight (48) hours after receipt of notification of the prize (“Confirmatory Email”). The Sweepstakes Winner must provide their full name, telephone number and mailing address in the Confirmatory Email. In the event the Sweepstakes Winner does not send this Confirmatory Email within the forty-eight (48) hour period, the Sweepstakes winner will forfeit the prize in accordance with Section 7.13 below.

6. Promoter

The Sweepstakes is organized on behalf of Harry Potter and the Cursed Child by Train Times Broadway LP (the “Promoter”). In order to administer the Sweepstakes, Promoter may make use of advertising or promotional agencies.

7. Prize Terms

7.1 All members of the Group:

  • Will be requested to execute and return a Release of Liability prior to participation in the trip
  • Are solely responsible for obtaining any and all necessary travel documents before departure (valid photo I.D., credit card, etc.)
  • Are responsible for any picture identification requirements associated with air travel.
  • Winner (or his/her parent guardian) is required to have and preset at least one major credit card in good standing in order to check-in to the hotel.

7.2 If the Sweepstakes Winner is unable to travel to London, England to attend the performance between September 1, 2019 – November 15, 2019, then the prize will be forfeited.

7.3 If the Sweepstakes Winner elects to partake in any or all portions of the prize with no Guest, the prize will be awarded to the Sweepstakes Winner and any remainder of the prize will be forfeited and shall not be subject to further or alternative compensation. 

7.4 The Sweepstakes Winner understands and agrees that Promoter has the right in its sole discretion, to disqualify and remove any member of the Group from any activity at any time if such Group member’s behavior at any point is disruptive or may or does cause damage to person, property or the reputation of Promoter, or an affiliate, or otherwise violates the Official Rules or policies of the Promoter.  The Winner acknowledges that he/she is solely responsible for any actions, claims or liabilities of Guest related to any sweepstakes-related activity or travel.

7.5 All elements of the prize must be redeemed at the same time, and no changes will be permitted after confirmation of any redemption.

7.6 Travel arrangements must be made through Promoter’s agent and on carrier of Promoter’s choice.  The Group will be asked to present all necessary travel information, including a photo copy of their valid passport(s), to Promoter to assist the Promoter in properly booking their travel arrangements. Travel will not qualify for frequent flyer miles, award points or any other perquisites.

7.7 If the Sweepstakes Winner is under the age of eighteen (18), the Guest must be a parent or legal guardian.

7.8 The prize consists only of the elements expressly set forth above; no other elements or expenses (including, without limitation, insurance, meals, ground transportation, accommodations that exceed a single hotel room over a 2-night stay, phone calls, gratuities, incidentals, souvenirs, gasoline, etc.) are included in the grand prize and all such expenses are the sole responsibility of the Sweepstakes Winner.

7.9 Once any element of the prize has been issued, it is non-transferable and may not be reissued.

7.10 The Promoter takes reasonable care to ensure that the prizes are as described in these Rules. However, events may occur that make the awarding of the prizes impractical or inappropriate due to unforeseen circumstances or reasons beyond the control of the Promoter. In this situation, the Promoter may vary or amend the prizes to provide a reasonable alternative as a result of which the Promoter or parties connected to the Promoter shall not be held liable.

7.11 No cash or credit alternative is available and the prizes are not transferable. Eligibility for the prizes may be subject to signing a Prize Acceptance Form.

7.12 Where applicable, the Sweepstakes Winner and/or the parents or legal guardians of the Sweepstakes Winner will be required to sign a Prize Acceptance Form within seven (7) days of the date of issuance. If the Prize Acceptance Form is not returned within the specified time period, the prize will be forfeited.

7.13 If a Sweepstakes Winner does not confirm acceptance of their prize within the required time period, he/she will automatically forgo their right to claim the prize and a runner up will be selected. If such runner up also fails to accept their prize in the required manner, the next runner up will be selected as an alternative Sweepstakes Winner and so on until another Sweepstakes Winner is chosen and has duly accepted in accordance with these Rules.

7.14 Prize redemption of the tickets to see HARRY POTTER AND THE CURSED CHILD in London at the Palace Theatre, will occur on the day of the performance from the Palace Theatre Box Office located at Shaftesbury Avenue, London EID 5AY.  The winner must be present to collect the tickets with a valid photo ID.

7.15 Prize is not for resale. 

8. Changes to Rules

Subject to applicable law, the Promoter reserves the right to modify the Rules at any time without notice to Entrants. In such circumstances, updated Rules will be uploaded to and published on harrypottertheplay.com/us/sweepstakes.

9. Eligibility of Entries

9.1 Ineligible or fraudulent Entries are void. All Entrants will be deemed to have authorized the Promoter to check the completeness and accuracy of the information they supply for purposes of participation. An Entrant who has supplied incomplete, inaccurate or fraudulent information will be automatically disqualified. Any Entry that uses offensive or inappropriate language will automatically be disqualified.

9.2 The Promoter is not responsible for lost, late, or misdirected Entries, for technical, hardware or software failures of any kind, for lost or unavailable network connections, or for failed, incomplete, garbled or delayed computer transmissions or any human error which may occur in the receipt or processing of the Entries.

9.3 The Sweepstakes is not open to employees or contractors of the Promoter, including each of their affiliates, subsidiaries, divisions, or any person directly or indirectly involved in the organization or running of the Sweepstakes or their direct family members.

9.4 In the event of a dispute regarding the identity of the person submitting an Entry, the Entry will be deemed to be submitted by the person in whose name the e-mail account is registered on the date the Entry is submitted. All Entries become property of the Promoters and will not be returned.

9.5 Entries shall not be returned to Entrants.

10. Post-Sweepstakes Publicity

The Sweepstakes Winner may be invited and agree to take part in post-Sweepstakes publicity as may be requested by the Promoter. By accepting the prize, to the fullest extent permitted by applicable law, the Sweepstakes Winner consents that the Promoter may use his/her name, photograph, likeness (including his/her voice), hometown and biographical information and statements concerning the Sweepstakes or the Promoter and/or its products without further compensation or notice for the purpose of advertising, promotion, and merchandising, throughout the world in perpetuity, and the Sweepstakes Winner grants all rights to edit or modify and to publish and copyright such details.

11. Use of Personal Information

In order to participate in the Sweepstakes, Entrants will be required to supply certain information about themselves on the Sweepstakes entry page. The Sweepstakes entry page has specified which information is mandatory in order to participate in the Sweepstakes. This information will be used by the Exhibition for the purposes of administering the Sweepstakes.

12. Limitation of Liability

12.1 The Promoter does not accept any responsibility for any occurrences resulting from the Entrants’ connection to the internet via the website and/or resulting from participation in the Sweepstakes. In particular, the Promoter does not accept responsibility for any damage or loss caused in any way to Entrants, their computer equipment and/or to data which is stored on any such equipment, or to their personal, professional or commercial activities.

12.2 If, for any reason, the Sweepstakes is not capable of running as planned, including infection due to computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the control of Promoter that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes. Promoter reserves the right to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify, or suspend the Sweepstakes and let the Promoter select the Sweepstakes Winner from all eligible Entries received prior to the cancellation or termination of the Sweepstakes.

12.3 In the event of unforeseen circumstances, the Promoter reserves the right to substitute any or all parts of the Sweepstakes. In this event, such a change will be publicized on harrypottertheplay.com/us/sweepstakes and any necessary amendments to these conditions will be made.

12.4 Entrants agree to the fullest extent allowed by applicable law to release and forever discharge Promoter, and its parent corporations, subsidiaries, assigns and employees, and any entity or person connected with the Sweepstakes from and against any and all claims, demands, losses and liabilities of any nature whatsoever which may now or hereafter arise, including but not limited to any loss of enjoyment, costs, delays or other harm or loss of any nature whatsoever caused by, contributed to, or arising out of or in connection with the prizes.

12.5 If any court or competent authority decides that any of the provisions of these Rules are invalid, unlawful or unenforceable to any extent, the Rule will, to that extent only, be severed from the remaining Rules, which will continue to be valid to the fullest extent permitted by law.

12.6 Any attempt by an Entrant to deliberately damage the website or to undermine the legitimate operations of the Sweepstakes may be a violation of criminal and civil laws and should any such attempt be made, the Promoter reserves the right to seek damages from any such person to the fullest extent permitted by law.

12.7 The Promoter reserves the right to change, suspend or cancel the Sweepstakes without specifying the reasons for its decision and without incurring liability as a result. These Rules will apply to the Sweepstakes. The Promoter reserves the right to modify these Rules at any time prior to, during or after the Sweepstakes Period.

12.8 By entering the Sweepstakes, Entrants agree to release any social networking site that the Sweepstakes may be accessed through from any and all liability connected with the Sweepstakes.

12.9 If applicable law does not allow all or any part of the above limitation of liability to apply, the limitations will apply only to the extent permitted by applicable law.

12.10 The Sweepstakes is governed by the laws of the state of New York, located in the United States. You hereby consent and submit to the exclusive jurisdiction of the courts in the state of New York for any action however so arising out of these Rules.
